Penalties for Violating the FBPA?
If a business or person violates the Fair Business Practices Act, the victim can take civil action against the violator. The victim may be entitled to equitable injunctive relief, general damages sustained due to the violation, and attorney’s fees.
If it is determined that the violation of the FBPA was intentional, a court will award three times actual damages. O.C.G.A. § 10-1-399
Increased Damages for Fair Business Practices Act Violations Against the Elderly
If a person or company is determined to have conducted business in violation of the FBPA and is found to have committed the violation against the elderly or disabled persons, the court may impose an additional civil penalty up to $10,000.00 for each violation. O.C.G.A § 10-1-851.
The statute defines an “Elder person” as a person who is 60 years of age or older. O.C.GA. § 10-1-850 (2).
